Terms of Service

1. Agreement to Terms

By accessing or using ATC Personal ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ATC Personal is a platform provided by HLD Software Group that facilitates access to counselling and mental health support services. We connect individuals with qualified counselling professionals and provide tools for booking and managing counselling sessions.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Counselling Services

All counselling services are provided by independent, qualified professionals. HLD Software Group does not provide medical or clinical advice. The platform serves as a connection tool only. Any advice or treatment provided during counselling sessions is the sole responsibility of the counselling professional.

5. NDIS Services

For participants using NDIS funding, services are provided in accordance with NDIS guidelines. Plan-managed and self-managed participants should ensure they have appropriate funding allocation before booking sessions. Receipts will be provided for claiming purposes.

6. Payment Terms

Payment terms vary by service type:

  • Private Pay: Payment is required at time of booking
  • NDIS Plan-Managed: We bill your plan manager directly
  • NDIS Self-Managed: Invoices provided for claiming through myplace portal
  • EAP: Billed to employer/organisation

7. Cancellation Policy

We require at least 24 hours notice for cancellations. Sessions cancelled with less than 24 hours notice may incur a 50% cancellation fee. Repeated no-shows may result in suspension of booking privileges.

8. Privacy & Data

Your privacy is important to us. We collect and process personal information in accordance with the Australian Privacy Principles and our Privacy Policy. All session content and personal data is encrypted and stored securely. For more details, see our Privacy Policy.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service
  • Harass, abuse, or harm other users or counselling professionals
  • Use the platform to book sessions you do not intend to attend

10. Limitation of Liability

To the maximum extent permitted by law, HLD Software Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting on this page. Your continued use of the Service after changes constitutes acceptance of the new terms.
